American Gear Company
Effective Date: October 22, 2026

1. Overview

Welcome to American Gear Company ("AGC," "we," "us," or "our"). By accessing our website, placing an order, requesting a quote, or purchasing our products, you agree to these Terms & Conditions.

American Gear Company specializes in manufacturing and selling custom and standard products, including snowboards, skateboards, surfboards, wakesurfers, arcade cabinets, promotional merchandise, and related accessories.

These Terms & Conditions govern purchases, custom manufacturing, artwork submissions, order fulfillment, and use of our website.

Please review these terms carefully before making a purchase.

2. Products & Product Information

We strive to provide accurate product descriptions, photographs, dimensions, specifications, and pricing.

Because many of our products are manufactured individually or in production batches, minor variations may occur in:

  • Color, graphics, and printed finishes.

  • Wood grain, natural materials, and surface textures.

  • Dimensions and manufacturing tolerances.

  • Hardware and component appearance.

  • Product finishes and construction details.

We reserve the right to make reasonable manufacturing improvements or substitute components of equivalent or greater functionality and quality, provided these changes do not materially alter the purchased product.

If a material change becomes necessary, we will communicate with the customer and obtain any required approval.

Photographs and digital mockups are intended to represent products as accurately as reasonably possible. Actual colors may vary due to monitor settings, printing processes, material characteristics, and production methods.

3. Pricing & Payment

All prices are displayed in U.S. dollars unless otherwise indicated.

Prices, product availability, and specifications may change without prior notice. Changes will not retroactively modify accepted and paid orders without the customer's agreement.

Applicable taxes, shipping charges, and additional services will be disclosed during checkout or through an approved quotation.

Custom orders may require full payment or an agreed deposit before production begins.

Any applicable balance, milestone payment, or special payment arrangement will be identified in the accepted quotation or invoice.

We reserve the right to decline or cancel orders involving suspected fraud, unauthorized payment activity, or material pricing errors, subject to applicable law. If payment has been collected for a canceled order, the appropriate refund will be issued.

4. Custom Orders & Manufacturing

Many American Gear Company products are manufactured to customer specifications.

Custom orders may involve personalized artwork, specific dimensions, materials, product configurations, colors, branding, or other requested features.

By approving a custom order, the customer confirms that the approved specifications accurately reflect the intended product.

Production may begin after the required customer approvals and payments have been received.

Once production has begun, modifications or cancellations may not be possible without additional costs.

We will make reasonable efforts to accommodate change requests when production status permits.

Custom manufacturing estimates are based on available materials, production capacity, and the scope of the order.

5. Artwork Submission & Approval

Customers submitting custom artwork, logos, designs, or photographs represent that they own or possess the necessary rights and permissions to use those materials.

The customer is responsible for reviewing and approving artwork proofs before production, including:

  • Spelling and text accuracy.

  • Logo placement and orientation.

  • Colors and design elements.

  • Product dimensions and graphic positioning.

  • Image quality and resolution.

  • Required licensing or trademark permissions.

Once artwork is approved and production begins, American Gear Company is not responsible for errors that appeared in the approved proof, except where required by law or where the manufactured product does not reasonably match the approved specifications.

Additional charges may apply for requested changes, reprints, or remanufacturing resulting from customer-approved errors.

Artwork ownership remains with its respective rights holder.

Customers grant American Gear Company a limited right to reproduce, modify as necessary for production, and share submitted artwork with authorized production partners solely for fulfilling orders and related services.

We do not acquire ownership of customer-submitted artwork solely because it was provided for manufacturing.

Use of customer artwork for unrelated marketing or promotional purposes will require appropriate authorization.

6. Production Lead Times & Shipping

Production lead times vary depending on product type, order quantity, customization requirements, material availability, and manufacturing schedules.

Estimated production and shipping dates are communicated through product listings, quotations, order confirmations, or direct correspondence.

Production lead times and transit times are separate unless expressly stated otherwise.

We make reasonable efforts to fulfill orders within the stated timeframe.

If we determine that an order cannot ship within the applicable promised timeframe, we will provide notice and obtain consent to a delay or offer cancellation and a prompt refund as required by applicable law.

Once an order has shipped, delivery may be affected by carrier schedules, weather, transportation disruptions, or circumstances outside our reasonable control.

Any allocation of responsibility for loss or damage during shipment remains subject to applicable law and the agreed shipping terms.

7. Order Changes & Cancellations

Customers should contact American Gear Company as soon as possible to request an order modification or cancellation.

Standard Products

Orders for standard, non-customized merchandise may be eligible for cancellation or return under our published Refund Policy and applicable law.

Custom-Manufactured Products

Because custom products are created specifically for individual customers, cancellation options may become limited once materials have been purchased, artwork has been processed, or manufacturing has begun.

When permitted by law and disclosed before purchase, customers may be responsible for reasonable, documented costs already incurred in connection with a requested cancellation.

We will communicate any applicable charges before accepting a voluntary cancellation arrangement.

Products that are defective, materially different from the approved order, or otherwise subject to legally required remedies remain eligible for applicable relief.

Nothing in this section limits statutory cancellation or refund rights.

8. Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our separately published Refund Policy, together with applicable consumer protection laws.

Custom-manufactured, personalized, or specially configured products may have different return eligibility from standard inventory products.

Customers should review the Refund Policy before placing an order.

If a product arrives damaged, defective, or materially different from the approved specifications, contact American Gear Company promptly so we can evaluate the issue and identify the appropriate remedy.

Depending on the circumstances, available remedies may include repair, replacement, refund, or another resolution required by applicable law.

9. Warranty & Product Support

American Gear Company stands behind the workmanship and quality of its products.

Warranty coverage varies by product and is governed by the warranty terms expressly provided with the product or published in the applicable product listing.

Certain arcade cabinets may include a five-year limited warranty, as specified in the corresponding product documentation.

Other products may carry different warranty periods, coverage, or exclusions.

Any limited warranty must be interpreted according to its written terms, including applicable coverage, exclusions, claim procedures, and remedies.

Damage caused by misuse, unauthorized modification, neglect, improper installation, or use outside the product's intended purpose may be excluded from warranty coverage where permitted by the applicable warranty and law.

Warranty service may require proof of purchase and reasonable documentation of the reported problem.

Nothing in these Terms & Conditions limits any non-waivable warranty rights or remedies provided by law.

10. Arcade Products, Software & Digital Content

American Gear Company manufactures arcade cabinets and related hardware that may include computer systems, controllers, monitors, and optional software configurations.

Software compatibility and performance may vary depending on hardware specifications, operating systems, software versions, and game requirements.

Third-party software, emulators, and digital content are subject to their respective licenses and legal restrictions.

Customers are responsible for ensuring that independently added software and digital content are legally obtained and used.

Purchasing an arcade cabinet does not automatically grant ownership or licensing rights to third-party games or copyrighted software unless those rights are expressly included with the product.

Unauthorized modifications or third-party software installations may affect performance, compatibility, or warranty coverage, as described in the applicable written warranty.

11. Product Use & Safety

Customers are responsible for using products in accordance with their intended purpose and any provided safety instructions.

Snowboards, skateboards, surfboards, wakesurfers, wakeboards, and other sporting goods involve inherent physical risks.

Users should exercise reasonable care, use appropriate protective equipment, and follow applicable safety practices.

Products should be inspected for damage, wear, or unsafe conditions before use.

American Gear Company is not responsible for injuries or damages caused by misuse or unauthorized alterations to the extent permitted by applicable law.

Nothing in these terms excludes liability that cannot lawfully be excluded.

12. Wholesale, Promotional & Corporate Orders

Wholesale, reseller, and corporate promotional orders may be subject to separate written quotations, volume pricing, production requirements, payment terms, or distribution agreements.

Where separate written terms have been accepted by both parties, those terms will control in the event of a conflict with these general Terms & Conditions.

Unless otherwise agreed in writing, wholesale customers and resellers are responsible for their own customer-facing advertising, pricing, representations, and compliance obligations.

Use of American Gear Company trademarks, logos, product photography, or proprietary materials for resale or promotional purposes requires appropriate authorization.

13. Intellectual Property

The content on this website, including original text, graphics, photographs, designs, logos, product information, and other proprietary materials, may be protected by copyright, trademark, or other intellectual property laws.

Except as authorized by law or by American Gear Company, website content may not be reproduced, distributed, or used commercially without permission.

Customer-owned artwork and third-party trademarks remain the property of their respective owners.

Nothing in these Terms & Conditions transfers ownership of intellectual property unless expressly agreed in writing.

14. Website Use

Customers agree not to use our website for unlawful, fraudulent, or abusive purposes.

Prohibited activities include:

  • Attempting to gain unauthorized access to website systems.

  • Submitting fraudulent payment or account information.

  • Uploading malicious software.

  • Interfering with website security or operations.

  • Using the website to violate another party's intellectual property rights.

We reserve the right to restrict access or decline transactions when reasonably necessary to protect customers, our systems, or business operations.

15. Privacy & Communications

We respect customer privacy and handle personal information in accordance with our separately published Privacy Policy.

Customers may receive necessary communications relating to purchases, quotes, customer support, and order fulfillment.

Optional promotional email and SMS communications are subject to applicable consent requirements and customer preferences.

Our separate SMS Policy explains text messaging terms, consent, message frequency, and opt-out procedures.

Consent to receive marketing text messages is not required to purchase products from American Gear Company.

16. Third-Party Services

Our website may rely on third-party services for payment processing, website hosting, shipping, analytics, and customer communications.

These services may maintain independent terms and privacy policies.

American Gear Company is not responsible for independently operated third-party websites or services except to the extent required by applicable law.

17. Limitation of Liability

To the extent permitted by applicable law, American Gear Company will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or products, except where such limitations are prohibited.

Nothing in these Terms & Conditions limits liability for fraud, willful misconduct, or other matters that cannot legally be excluded or restricted.

Any applicable limitation of liability is subject to consumer protection laws, written warranties, and other mandatory legal obligations.

18. Governing Law & Disputes

These Terms & Conditions are governed by the applicable laws of the State of Utah, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

We encourage customers to contact us directly regarding concerns before initiating formal proceedings.

We will make reasonable efforts to resolve legitimate disputes promptly and fairly.

Nothing in these terms prevents customers from exercising rights available under applicable consumer protection laws.

19. Changes to These Terms

American Gear Company may update these Terms & Conditions from time to time to reflect changes in business operations, products, policies, or legal requirements.

Updated terms will be posted on our website with a revised effective date.

Changes will not retroactively alter the material terms of a previously accepted purchase without a lawful basis and any required agreement.
